TRAVEL SCOPE (INDIA) PRIVATE LIMITED TERMS & CONDITIONS

GENERAL CONDITIONS

1.1 Scope and Definitions

The below mentioned Terms & Conditions shall apply on all the bookings made with Travel Scope (India) Private Limited (“TS”) having its office at 215 Qutab Plaza, DLF Phase 1, Gurgaon, Haryana – 122002, India by any individual traveler and group (“Travelers”) intending to avail the Services of TS whether directly or through TS’s agents or TS’s associates located in overseas countries.

1.1.1 “Booking” shall be deemed to be completed by TS when the following conditions are fulfilled:

1.1.1.1 Traveler’s confirmation to the final itinerary has been received by TS;
1.1.1.2 A deposit, as set forth by TS, has been paid by the Travelers to TS, and receipt confirmed by TS;

1.2 Acceptance of Conditions

1.2.1 The following Terms and Conditions shall be applicable to all the Travelers making bookings with TS. The Travelers hereby give their consent to these Terms and Conditions in full and also agree to be bound by these Terms and Conditions.

1.2.2 The term booking shall include, services requested by a Traveler that includes accommodations including hotels, camps, lodges, ground transportation (cars, vans, buses) , air and rail travel (where booked by TS), local guides, tour escorts, experts, chartered flights (where a request has been made with TS to charter an aircraft or helicopter), special outdoor adventurous activities such as safaris by jeeps, boats, walking safaris, ziplining, river rafting, bungee jumping, hiking, trekking, bike rides, motorcycle rides, and all other activities that are requested by the Travelers or suggested by TS on the itineraries in tune with a Traveler’s interests. TS reserves the right to get a waiver / indemnity signed for all activities that involve an element of adventure or risk.

2. USE OF THE SERVICE

2.1 Eligibility

2.1.1 All Travelers who are 18 years of age or above are eligible to participate in a trip. Children under the age of 18 must be accompanied by a parent / guardian.

2.1.2 All Travelers are required to ensure their good health necessary for travelling. In the event, a Traveler opts for activities that are adventurous in nature, it shall be deemed that the Traveler has the minimum required level of fitness for participating in such activities. Prior to their arrival, Travelers are also required to notify TS about any constraints including physical disabilities such as inability to walk or take steps, climbing heights or medical conditions such as allergies to foods, medicines, or any specific health conditions.

2.2 General Booking Conditions

2.2.1 Pricing

2.2.1.1 TS assures its Travelers of maintaining prices as contracted for a particular tour. However, in the event of any increase in costs due to change in the existing govt. tax structures, introduction of new govt. taxes or revision of air fares or airline taxes, increase in costs of fuel etc.; all costs arising out of a modification of booking by Travelers or due to a waitlisted accommodation or for reasons beyond our control, such additional costs shall be borne by the Travelers and TS shall not bear any such additional costs.

2.2.2 Inclusions and Exclusions

2.2.2.1 The inclusions and exclusions of the cost of a trip shall vary from one tour to another. Please refer to the pricing document submitted by TS for a detailed list of inclusions and exclusions. Under no circumstances does TS include the cost of any kind of insurance such as insurance for travel, travel protection, health, medical repatriation etc. Such insurance will have to be purchased by the Travelers in their country of domicile at their own costs.

2.2.3 Itinerary

2.2.3.1 TS assures the Travelers that all efforts will be made to maintain the original itinerary as submitted at the time of booking. However, if required and for reasons beyond the control of TS like change in timings of a flight / train or cancellation of a flight / train, closure of a museum or a monument; or if day of closure of monuments/safari parks is changed by the concerned authorities, or strikes and including conditions/events specified in Force Majeure (refer clause 8), TS reserves the right to change the itinerary and the route or the order of the visits.

2.2.3.2 TS, wherever possible, will inform the Travelers about such changes prior to their departure. TS assumes no responsibility for any additional expenses and/or losses which might be incurred on account of delays or disruption of the planned itinerary due to the occurrence of any event beyond its control including the situations specified in clause 2.2.3.

2.2.4 Check-In / Check-Out Times

2.2.4.1 The Check-In and Check-Out times at hotels will be determined by the policies of each hotel or hotel chain. The standard time for check-in is 2 PM and check-out is 12 Noon. However, some hotels do have later check-in times. For earlier check-in travelers are required to pay an additional cost for availing themselves of a room immediately on arrival.

2.2.5 Third Party Services

2.2.5.1 By signing this Agreement Travelers agree and understand that TS may use services of Third-Party Service Providers and for rendering services. While TS endeavors to use service providers with acceptable standards, it neither owns nor operates such Third-Party Service Providers and is not the actual provider of these services. Such Third-Party Service Providers may also provide their own guidelines for facilitation of their services. The Travelers shall be responsible for ensuring compliance with such guidelines. In the event of any breach, the respective Traveler shall be personally liable and shall provide reimbursement for any damages and/or loss which might occur due to such a breach.

2.2.5.2 Travelers acknowledges that neither TS nor its owners, directors and employees shall be liable or responsible for any negligent or willful act or failure to act of any third party, such as operators of aircraft, trains, motorcoaches, private cars, rentals, boats, ships or any other conveyance, hotels, restaurants, tour guides, sightseeing excursions, local ground handling, outdoor activity organizers etc. The Travelers further agrees to seek remedies directly and only against those third parties and not hold TS responsible for their acts or omissions.

2.2.5.3 TS shall under no circumstances be held liable for any additional costs, loss and/or damage suffered by the Travelers on account of delay, cancellation and/or missing of flights (international or domestic) / or trains for the reasons not attributable to TS and beyond the control of TS. TS will endeavor to arrange another substitute flight/ train for the Traveler(s) at additional cost payable by the Travelers. In the event that any substitute flight/ train is not available, then the amount may be refunded by TS after deducting the cancellation charges and convenience charges / service fees as applicable from time to time. Further, TS assumes no responsibility, in the event of any baggage/ belonging is misplaced, destroyed, or lost, by an airline or Indian Railways (to the extent permitted). The Travelers shall be solely responsible for any such loss or damage caused by an airline or Indian Railways.

2.2.6 Ground Transportation

2.2.6.1 TS will provide ground transportation (cars, vans, buses) as mentioned in the itinerary. All vehicles possess a standard capacity for storing luggage and personal belongings of the Travelers. However, in the event, a Traveler is carrying quantity/ number of luggage beyond the standard capacity of the vehicles then TS will provide an extra vehicle at additional cost, solely attributable to the respective Travelers.

2.2.7 Airfare Fare

2.2.7.1 International air fare is not included in our prices unless and until specified. All airfares quoted (whether domestic or international) are subject to change until ticketed. Tickets will be issued only upon receipt of full payment of airfare/railway fare, due at the time of confirmation of the booking by a Traveler. Airfare tickets documents may include special conditions including restrictions such as baggage size and weight limit. Tickets are not transferable. The Travelers shall be responsible for carrying all the travel documents including but not limited to passport, visa, and boarding pass along with them at the time of departure. Travelers shall also ensure that they have provided the correct information such as name as in passport, dates of birth etc. while confirming a booking TS. Travelers further agree that TS shall not be liable in any manner for any loss or damage of any kind incurred by Traveler(s) as a result of any incorrect information provided by the Traveler.

2.2.8 Passport, Visa and Entry Permit:

2.2.8.1 Travelers understand and agree that they shall have a passport with a validity of at least 6 months from the date of return and also with sufficient blank pages. A valid visa is required for travelling in India and sub-continent countries such as Nepal, Bhutan, Sri-Lanka etc., irrespective of mode of transport i.e., either by air, sea, or land.

2.2.8.2 It is the sole responsibility of the Travelers (irrespective of their nationality) to obtain a valid passport, visa and other documents/pre-approvals as may be required for travelling in India and sub-continent countries, prior to their departure from their respective countries. It is suggested by TS that Travelers shall contact consulates, travel agents, VISA service agents in their country of domicile to check on such requirements and regulations required for travelling in Indian and sub-continent countries, as they may change from time to time.

2.2.8.3 No refunds shall be granted for unutilized services, in the event, a Traveler is denied boarding at any entry point or even after landing in India or in any of the sub-continent countries for reasons including but not limited to, not possessing a passport, visa, being quarantined at any airports in India or the sub-continent for health / medical reasons and non-compliance of any health, cancellation of flights by the airlines and inoculation requirements as may be laid down from time to time by the concerned authorities.

2.2.9 Behaviour and Conduct

2.2.9.1 The Travelers must abide by the authority of the Trip leader (i.e., the tour guide, or anyone else assigned by TS). The Trip leader may terminate or suspend the participation of any Traveler who commits any illegal act, behaves in a manner causing or likely to cause danger, distress, or annoyance to other persons, does not feel well or becomes ill or might infect other Travelers, or required to be quarantined. These behavioral standards apply also to specific rules, health requirements and regulations authorized by any public authority or private property, regarding any aspect of the Travelers stay during the trip. Termination or suspension under this clause will not create any liability on TS part, and no refund will be made against cost of unutilized services as a result of such circumstances. Under no circumstances will TS be liable in any manner for any behavior of Travelers, including, without limitation, for any loss or damage of any kind incurred by Passengers as a result of such behavior.

2.2.9.2 Travelers are required to maintain a certain code of conduct while travelling in India and any of the sub-continental destinations. Travelers are also required to respect the local culture and religion.

2.2.9.3 Travelers are also responsible for the safety and security of their personal belongings, artefacts, cash, valuables etc. While guides of TS and representatives’ endeavor to brief Travelers on all security measures to be undertaken by Travelers, but it is the sole responsibility of the Travelers for the safety and security of their personal belongings, artefacts, cash, valuables etc. and TS will not be held responsible or liable for any loss/damage, in case of any pick pocketing or thefts.

2.2.9.4 No Traveler shall do anything or transmit any material that might constitute a criminal offence or give rise to any civil liability. Under no circumstances will TS be liable in any manner for any behavior of Traveler(s), including without limitation, for any loss or damage of any kind incurred by Traveler(s) as a result of such behavior.

2.2.10 Health and Hygiene

2.2.10.1 Acknowledgment of Good Health and Capacity: The Booking confirmation is made with the understanding that all Travelers are in satisfactory health and possess the physical and mental capability necessary to meet the demands of the trip.

2.2.10.2 Disclosure of Conditions: In the event that any Traveler is affected by a medical or other condition that might impact their own or fellow Travelers’ enjoyment of the trip, or their ability to participate in planned activities, it is incumbent upon the Traveler to promptly inform the guide, TS Staff, or the designated trip leader. Such notification should occur at the time of booking or, if not possible at that time, as soon as the Traveler becomes aware of the condition, either before or during the course of the trip.

2.2.10.3 Medical Certification: TS reserves the right to request a valid medical certificate from a qualified healthcare professional, detailing the Traveler’s medical condition and confirming their fitness to participate in the trip.

2.2.10.4 Authorization for Medical Treatment: The Travelers hereby grant TS and its designated personnel authorization to provide any necessary medical treatment in the event of an injury sustained during the course of the trip.

2.2.10.5 Health Restrictions and Instructions: In cases where a Traveler’s health restricts their participation in specific foods, materials, conditions, or activities (e.g., due to allergies or sensitivities), the Traveler is obliged to promptly inform the TS and provide comprehensive written instructions outlining the said restrictions. TS, utilizing its expertise, reserves the sole discretion to assess the Traveler’s capacity to participate in the trip or specific activities. While TS will communicate relevant allergies or conditions to associated vendors and activity providers, it remains the sole responsibility of the Traveler to carry required medications and notify activity providers of any allergies or special conditions before engaging in an activity.

2.2.10.6 Food Allergies and Dietary Restrictions: Travelers (or legal guardians in the case of minors or individuals under care) shall take on the responsibility of verifying with the designated person responsible for food preparation that all meals align with the Traveler’s dietary needs and restrictions prior to each meal.

2.2.10.7 Liability Disclaimer: Travelers acknowledge and agree that TS shall bear no responsibility under any circumstances for physical or mental reactions, or any resulting consequences stemming from allergies, food, health conditions, or any other factors.

2.2.10.8 Covid-19 Compliance: Travelers are bound by the responsibility to adhere to all Covid-19 related regulations, restrictions, and protocols throughout the duration of the trip.

2.2.10.9 Covid-19 Liability Disclaimer: TS shall not be held liable, under any circumstances, for any Traveler’s contraction of the Covid-19 virus, imposition of quarantine requirements, or any resultant outcomes prior to, during, or after the trip. This includes instances involving minors or individuals under care. As a result, no refunds or compensation will be provided.

3. PAYMENTS AND DEPOSITS TERMS

3.1 All Travelers are required to make a 25% deposit (land cost + domestic air fare) at the time of booking for all tailor-made itineraries and special bookings. The balance payment shall be made a minimum of 60 days prior to arrival or in some cases 60 to 90 days prior to arrival depending on period of travel, such as Christmas, New Years, or other peak periods of travel. Travelers may also be required to pay non-refundable deposits for such as but not limited to Christmas, New Years. Such deposits will be guided by the individual cancelation policy of hotels and other vendors and or forfeited in case of cancellation of the trip for any reason. Further, Bookings made within 60 days of the trip’s start require full advance payment to ensure sufficient time for arrangements.

3.2 Travelers can make payments by wire transfer, or Credit Cards such as VISA, MASTER, AMEX. Subject to a convenience fee of 3% of the total invoice for all credit card transactions. All payments made using Credit Cards such as VISA, MATER or AMEX Cards will be subject to a processing fee of 3% which will be added to the total tour costs. TS further reserves the right to alter any and all of its fees from time to time on account of increase or revision in any fee, duty, taxes etc. Travelers may be required to sign documents authorizing TS to charge their cards as per the regulations of banks or credit card services.

3.3 TS shall not be held liable for financial losses resulting from cyber incidents or unauthorized access to communication channels, including email. Travelers are responsible for verifying payment instructions and are encouraged to exercise caution. It is further clarified that for all online payments made using credit cards, TS employs a secure payment gateway for safety of the Travelers.

3.5 TS reserves the right to adapt terms for group tours and specialized trips as necessary, with clear communication of changes applicable solely to those specific tours. Changes to travel dates after confirmation may incur a change fee, based on availability, time, and associated costs.

4. CANCELLATION AND REFUNDS

4.1 In the event, a Traveler cancels a Trip, the Traveler should notify TS in writing at-least 60 days prior to travel. A cancellation fee will be charged by TS for all cancelled bookings, as per the following cancellation terms.

59 to 30 days 50% of the total tour cost
Below 30 days 100% of the total tour cost

4.2 Any refunds due to travelers on account of a cancelled booking shall be paid after deducting cancellation charges as per the above cancellation terms. No refunds shall be made for bookings cancelled under 30 days prior to travel.

4.3 In the event, a trip is not confirmed for any reason whatsoever, TS will process the refund and intimate the Travelers about the same. TS is under no obligation to make another booking in lieu of or to compensate/ replace the unconfirmed one. All subsequent further bookings will be treated as new transactions with no reference to the earlier unconfirmed reservations.

4.4 In situations of Force Majeure, encompassing but not limited to events like pandemics such as Covid-19 (as mentioned in clause 7), should specific travel restrictions be imposed by a State or country, travelers retain the right to cancel their bookings. It is understood by the travelers that, under such circumstances, TS (the Company) holds the exclusive authority to determine the feasibility of travelers undertaking the trip or any scheduled activity(ies). In cases of cancellation, TS will initiate a refund to the travelers, deducting applicable taxes remitted to relevant tax authorities, fees, charges paid to Third Party Service Providers in advance, administrative fees, and processing fees. TS will make every effort to process this refund, subject to such deductions. Additionally, TS reserves the right to hold the tour costs/deposits to be adjusted against a future

trip within a specified timeframe. Refunds, if applicable, shall be subject to a period of one year from the date of deposit receipt or as mutually agreed upon between TS and the client. After the expiration of this designated period, the deposit/payment shall be deemed forfeited.

4.5. It is vital to note that no refunds or adjustments will be entertained if a passenger starts the trip late or terminates it prematurely due to any reason, including emergency situations such as illness, accidents, or familial circumstances. TS disclaims responsibility for any financial claims arising from such occurrences.

5. INSURANCE

5.1 Travelers undertake that they are adequately covered by travel insurance, prior to their departure. It is advisable that the travel insurance must cover personal accident, medical expenses, evacuations and repatriation, baggage loss and cancellation or curtailment of Holidays. The Travelers shall choose their travel insurance according to their own requirements in their country of origin or domicile.

5.2 In cases of severe illness or incapacitation requiring specialized evacuation, such as helicopter or air ambulance services, the Traveler accepts full financial responsibility for all associated costs, including transport, medical personnel, and related expenses. TS bears no responsibility for arranging or covering these expenses and is not involved in reimbursement or claims processes.

5.2 TS reserves the right to request the Travelers to produce insurance documents prior to their arrival or after their arrival in India. TS also reserves the right to cancel the booking, in the event, TS discovers that the Traveler(s) has not obtained adequate travel insurance. TS shall not be liable, in the event, Travelers wishes to travel without adequate or no insurance cover then such a trip shall be at their own risk. Further the Traveler shall also sign a disclaimer, indemnifying TS of all liabilities arising out of such travel for any expenses and/or losses/claims which might be incurred owing to inadequacy or lapse on the part of the Travelers to obtain such insurance.

5A. MEDICAL EMERGENCY

5A.1 In the event of any emergency arising during the trip including without limitation, relating to disclosed or undisclosed medical condition and / or otherwise, TS will endeavor to provide Travelers with assistance, including access to medical professionals, ambulances, and related services on a best effort basis. TS will extend all support to the best of its ability; however, TS does not extend any implied or express representation, regarding the availability of such services at the location of the trip, nor shall it be contractually bound to do so. Any and all costs incurred for such assistance shall be borne by the Travelers directly and TS will not be responsible for making any advance payment or reimburse any cost incurred in relation thereto.

5A.2 In view of the Covid-19 pandemic, all costs and implications related to Covid-19, including testing, quarantine, medical treatment, and itinerary adjustments, shall be the sole responsibility of the Traveler. TS shall neither be deemed liable nor accountable for any Covid-19-related situations or associated costs incurred during the trip. Travelers are strongly advised to stay updated on Covid-19 developments, adhere to relevant guidelines, and secure appropriate insurance coverage. By choosing to travel with TS, Travelers acknowledge and assume full responsibility for any Covid-19-related expenses and consequences.

6. LIMITATION OF LIABILITY

6.1 While TS endeavors to use Third Party Service Providers with acceptable standards, it neither owns nor operates such third-party suppliers. The Travelers acknowledges that neither TS, nor its directors, employees, shareholders etc. shall be held responsible for any negligent or willful act(s) / failure to act (leading to any personal or financial injury or loss to the Travelers), of any Third-Party Service Provider(s). Travelers agree to seek remedies directly and only against Third-Party Service Provider(s) and not hold TS responsible for their act or omission. Travelers specifically agree to waive any and all rights to, either in law or in equity, claims, damages (including special and consequential damages), costs, expenses, proprietary or personal injury (including death), or

any other compensation of any kind whatsoever against TS and TS’s director(s), employees, shareholders etc. that arise directly or indirectly with respect to Travelers.

6.2 TS or its suppliers shall not be held liable to Travelers for any incidental, consequential, special, indirect, or exemplary damages arising from our services, merchant links, licensed products, encompassing potential losses in profits, cover costs, use, or business operations, irrespective of prior advice on such possibilities. Regardless of any contrary stipulations, TS assumes no financial responsibility for any circumstances encountered by Travelers in connection with this agreement, irrespective of the cause or nature of the action. Under no circumstances shall the total cumulative liability of TS under these terms and conditions, whether grounded in contract or otherwise, exceed the amount legitimately paid by the Traveler to TS.

7. FORCE MAJEURE

7.1 Travelers agree and understand that TS, TS’s affiliates and Associates and Partner Providers may not be able to perform their respective obligations in an event of Force Majeure.

7.2 For the purpose of these Terms and Conditions Force Majeure shall mean any event or circumstances or a combination of events and circumstances, which satisfy all the following conditions: –

a. Such events which are beyond the reasonable control of the affected party;
b. TS, TS’s affiliates, and Third-Party Service Providers could not have prevented or reasonably overcome with the exercise of good industry practice or reasonable skill or care;
c. Such an event which does not result from the negligence or misconduct of/ from/ by such party/ their representatives/ employees/ agents as the case may be, or the failure of such party to perform its obligation hereunder;
d. War (whether declared or undeclared), invasion, armed conflict, or act of foreign enemy in each case involving or directly affecting India and the sub-continent;
e. Revolution, riot, insurrection or other civil commotion, act of terrorism or sabotage in each case within India or the Indian Sub-Continent countries covered on our itineraries;
f. Nuclear explosion, radioactive and chemical contamination or ionizing radiation, directly affecting the area;
g. Strikes or working to rule, go- slows and/ or lock outs which are on each case widespread nation wise or political;
h. Any affect of the natural elements including lighting, fire, earthquake, unprecedented rains, cloud bursts, flash floods, landslides, storms, cyclone, tsunami, typhoon, or tornado;
i. Explosion (other than a nuclear explosion or an explosion resulting from an act of war);
j. Epidemics and pandemic;
k. Any major accident or breakdown which is not brought about by an act of sabotage by TS or anyone affiliated to TS or any of their employees or servants or agents;
l. Any fire, which is not the effect of natural element.

8. ARBITRATION

8.1 Travelers hereby agree that any and all disputes, claims, questions, or disagreements arising out of or in relation to these Terms and Conditions. The Parties shall endeavor to settle such disputes amicably through discussion within a period of 30 days from the date of notice by either party of the dispute. Failure to which shall lead to initiation of Arbitration proceedings as specified under the law of arbitration applicable in India, i.e., the Arbitration and Conciliation Act, 1996 (as amended or substituted) from time to time.

8.2 Notice for Arbitration shall be served within 30 days of failure of parties to settle the dispute amicably through discussion. The dispute(s) shall be referred to a Sole Arbitrator to be appointed by the Director(s) of TS. The venue of Arbitration shall be Delhi or Gurgaon, India and the proceedings shall be conducted in English language. Further, the notice served on the email ID of the Traveler(s) shall be deemed to be considered as valid service of the notice.

9. INTELLECTUAL PROPERTY

9.1 Travelers hereby undertake and understand that any and all photographs, motion pictures, recordings, and/or likenesses of these being captured during a Trip organized by TS or its affiliated entities or contractors, shall become the sole property of TS. The Travelers grant the right, permission and authority to TS and its designees to use their name and any such photographs, motion pictures, recordings, and/or likenesses for any legitimate purpose, including but not limited to promoting, advertising, and marketing activities. Further, TS and its designees have the full right to sell and/or earn profits from the commercial use of such photographs, motion pictures, recordings and/or likenesses.

10. PRIVACY POLICY

10.1 The Privacy Policy covers all practices concerning collection, processing including Third Party Service Providers, handling and securing the Travelers’ personal information by TS.

10.2 To the extent required by applicable law, Travelers consent will be obtained prior to disclosure of any sensitive personal data.

10.3 This Privacy Policy is applicable to persons who purchase any product or service from TS via any sales channel (including but not limited to website, mobile site, offline channels such as call centers, retail offices, through Travel Agents or any other channels.

10.3 Collection and Use of Personal Information

10.3.1 Travelers may be asked for personal information anytime they are in contact with TS directly or indirectly through a third party. The Travelers shall furnish specific consent for collection of their personal data in the form and format as may be deemed necessary by TS.

10.3.2 Should Travelers purchase travel and/or related services or choose to go through the TS website or mobile site, they have to provide TS with certain personal information such as name(s) of persons travelling (name of traveler if the person travelling is different to the one purchasing), passport details (with scanned copies), residential address, phone number, email id, debit/credit card number and expiry date, debit/credit card billing address. Other personal information may be requested too in order to confirm and fulfil the Travelers bookings and in order to keep the Travelers informed of each booking. If a booking is made in the name of/for other Travelers, then it is the duty of the Traveler(s) who is/are booking, to ensure these other Travelers have agreed beforehand that their personal information may be disclosed. In the event the Traveler(s) is / are below the age of 18, the parent / guardian of the Traveler will have to give consent for collection of aforesaid data.

10.3.3 If Travelers choose to register/get in touch on the website or mobile site, they may have to provide personal information including but not limited to their name, telephone number, e-mail address, and a unique login name.

10.3.6 TS may share personal information with Third Party Service Providers as required to fulfill the service offering and/or to make bookings, reservation, blocking and any such activity initiated by Travelers.

10.3.7 TS has stringent security measures in place to protect the loss, misuse, and alteration of the information under its control. Whenever a payment gateway is accessed, TS offers the use of a secure server.

10.3.8 By using TS and/or by providing their information, Travelers consent to the collection and use of the information disclosed in accordance with this Privacy Policy, including but not limited to consent for sharing their information as per this Privacy Policy.

10.3.11 TS may disclose personal information if required to do so by law or in the good-faith belief that such action is necessary to:

(a) conform to the edicts of the law or comply with legal process served on Travel Scope (India) Private Limited or the site;
(b) protect and defend the rights or property of TS the site or the users of TS and
(c) act under exigent circumstances to protect the personal safety of users of TS, the site, or the public.

11. DISCLAIMER

11.1 The information, software, products, and services included on TS’ website/ mobile site may include inaccuracies or typographical errors and TS will be entitled to rectify such inaccuracies or typographical errors. TS will not be liable/responsible for any decision that Travelers may take based on inaccurate information.

11.2 Advice received via this website/mobile site should not be relied upon for personal, medical, legal, or financial decisions and Travelers should consult an appropriate professional for specific advice tailored to their situation. TS and/or its respective suppliers make no representations about the suitability, reliability, timeliness, and accuracy of the information, software, products, services, or any other items and related graphics contained on this web site for any purpose whatsoever. All such information, software, products, services, and related graphics are provided “as is” without a warranty of any kind. TS and/or its respective suppliers hereby disclaim all warranties and conditions with regard to this information, software, products, services, and related graphics, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title, and non-infringement.

11.3 Please ensure that all information provided during booking is correct. For security reasons and to be able to advise Travelers of any developments affecting their travel, TS may be required to contact Travelers by telephone and email and to have correct addresses on record. If any or all of these contact details are not correctly given, TS reserves the right to cancel the transaction at the Travelers’ risk and cost.

12. MODIFICATION OF TERMS OF USE

12.1 TS reserves the right to change the terms, conditions, and notices under which TS websites/mobile sites are offered, including but not limited to the charges. The Traveler is responsible for regularly reviewing these terms and conditions.

13. INDEMNIFICATION

13.1 Travelers agree to indemnify, save, and hold TS, its affiliates, contractors, employees, officers, directors, agents, shareholders and its third party suppliers, licensors, and partners harmless from any and all claims, losses, damages, and liabilities, costs and expenses, including without limitation legal fees and expenses, arising out of or related to: (i) Travelers use or misuse of TS Services; (ii) any violation by Travelers of this Agreement or (iii) any breach of the representations, warranties, and covenants made by Travelers herein.

14. GOVERNING LAWS

14.1 Any dispute that may arise between the parties to this agreement shall be resolved through arbitration as given in clause 8.

14.2 Should the Parties fail to reach a commonly accepted settlement under the abovementioned arbitration, they are free to seek remedy from the Court of Law, as governed by the laws of India. In any case of a legal dispute, the sole jurisdiction shall lie within the competent courts of New Delhi, India.

15. SEVERABILITY

15.1 If any provision of this Agreement is held to be unlawful, void, invalid or otherwise unenforceable, then that provision will be limited or eliminated from this Agreement to the minimum extent required, and the remaining provisions will remain valid and enforceable.

Note: Travelers shall be deemed to have read and accepted these Terms and Conditions (T&C) when a booking is completed with Travel Scope.
